13. Ownership & Copyright
All architectural designs, drawings, and digital models remain the exclusive intellectual property of the Architect. Ownership and the right to use the designs shall only transfer to the Client upon receipt of 100% of the total agreed fee. Any use of designs prior to full payment constitutes copyright infringement.
14. Payment Schedule & Late Fees
Payments are due strictly within [e.g., 7] days of invoice issuance. Late payments will incur a penalty interest of [e.g., 2%] per month from the due date.
15. Right to Suspend Services
The Architect reserves the absolute right to suspend all services and withhold all final high-resolution files if any milestone payment is overdue. Work will only resume once the outstanding balance, including late fees, is cleared in full.
16. Fraud & Legal Action
Intentional non-payment after receiving full service will be treated as "Cheating and Fraud" under the Bharatiya Nyaya Sanhita (BNS). In such cases, the Architect will:
- File a formal Cybercrime Complaint for online payment fraud.
- Initiate a Civil Recovery Suit to recover the balance with interest and legal costs.
- Withhold the No Objection Certificate (NOC), preventing any other architect from taking over the project.
17. Dispute Resolution
Any payment disputes shall be settled through Arbitration in Motihari Jurisdiction under the Arbitration and Conciliation Act, 1996.
